Anoxic Brain Injury

With Over Twenty Years of Experience, Jed Dietrich, Esq. of Buffalo, New York, Is Determined to Represent Individuals Throughout New York State and Beyond Who Have Had Their Lives Negatively Impacted as a Result of Anoxic Brain Injuries.

According to the Centers for Disease Control, over the course of a ten-year-period, roughly ten individuals die by drowning each day. Approximately 50% of the victims who almost drown are hospitalized to address further medical complications. Near drowning is one of the most common causes of an anoxic brain injury. “Anoxia,” which literally means ‘without oxygen,’ refers to a sudden lack of oxygen in the body. An anoxic brain injury is a serious condition that results when the brain does not get sufficient oxygen. Without oxygen, the brain cells begin to die, leading to severe and often permanent side effects.

Jed Dietrich, Esq., recognized as a New York Super Lawyer, is well acquainted with the often-calamitous effects of personal injury. He has represented countless clients over the years, attaining over $175,000,000 in successful verdicts and settlements for his personal injury clients. If you believe that you or a loved one have been injured in Buffalo, New York, do not hesitate to reach out to the Dietrich Law Firm P.C. at 716-839-3939 or by filling out the online consultation form.

Causes and Symptoms

An anoxic brain injury occurs when the brain fails to receive oxygen. Oxygen is a critical component of the human body. Without it, the energy signals, known as electrochemical impulses, cannot pass between the cells, and as a result, the body loses its ability to function. The brain uses roughly 20% of the body’s total oxygen supply. Without oxygen, the cells of the brain quickly die, which in turn leads to the lasting and debilitating side effects common in brain injuries. Hyperbaric Medical Solutions lists seven common causes of anoxic brain injury. These causes are:

  1. Stroke, cardiac arrest, or low blood pressure;
  2. Drug overdose;
  3. Near drowning or choking; and
  4. Carbon monoxide poisoning.

The side effects of an anoxic brain injury manifest as a failure of the functions normally regulated by the brain. These side effects can include headache or seizures, loss of coordination, difficulty balancing, memory loss, problems with speech, difficulty swallowing, and depression, to name just a few.

Hypoxic Vs. Anoxic Brain Injury

Similar to an anoxic brain injury, a hypoxic brain injury also results from a loss of oxygen to the brain. In the case of hypoxic brain injuries, oxygen flow is restricted but not completely cut off. This is in contrast to anoxic brain injuries, in which no oxygen is able to reach the brain. Because both types of brain injuries involve a disruption in the flow of oxygen, they are typically called HAI’s or hypoxic-anoxic injuries. A hypoxic brain injury is less severe than anoxic but can still cause life-altering side effects, such as short-term memory loss, an inability to process visual cues, and anomia, which is the sudden inability to speak or understand the speech of others.

The treatment options for HAI’s are, unfortunately, very limited and, in many cases, minimal in their effectiveness. In spite of this, therapy remains one of the best options for recovering the everyday skills that were lost on account of a brain injury. Physical therapy is sometimes helpful in regaining lost motor skills, and speech therapists can work to retrain individuals suffering from speech difficulties.

An anoxic brain injury can be a negatively life-altering experience. In the event that an accident leads to a brain injury, Jed Dietrich, Esq. is fully prepared to represent you. He and his team of top lawyers are aggressive, tenacious, and hardworking and will fight to obtain compensation on your behalf. Liability In Cases Of Anoxic Brain Injury

Three of the causes of anoxic brain injury listed above are potentially the responsibility of another individual, and as a result, might be applicable for a negligence lawsuit. For public pools, it is a requirement in New York State that all lifeguards be CPA certified. It is their responsibility to ensure that the individuals visiting public pools are safe and to administer any first aid or CPR necessary. A carbon monoxide poisoning lawsuit can be brought against a business for failing to ensure the safety of its employees or customers or against a product manufacturer for producing a defective product. In cases of choking, one of the most common lawsuits involves nursing homes. Similar to lifeguards, it is the responsibility of the nursing home staff to ensure that patients are being watched over and, in instances of choking, that correct medical care is administered.
