Helmets And Face Shields
Under New York Vehicle and Traffic Law, Section 381(6), all motorcycle riders and their passengers must wear protective helmets. The helmet must meet the requirements specified in Section 571.218 of the Federal Motor Vehicle Safety Standards. Bikers must show they have a New York State Department of Transportation (NYSDOT) approved helmet to obtain a license and register their motorcycle. Section 381(7) also requires bikers to wear a face shield or goggles that the American National Standard Institute approves.
Roadway Regulations
All motorcyclists must abide by the same traffic laws as motorists in other vehicles. However, some other laws have been enacted to protect bikers and prevent severe injuries because of the risks involved with riding. Riders must adhere to the following laws:
- Lane Splitting: Although motorcyclists commonly ride between lanes of stopped or slowly moving traffic in the same direction, lane splitting is illegal. Bikers are also forbidden from weaving in and out of traffic.
- Riding Side by Side: A maximum of 2 motorcyclists can share the same lane.
- Passenger Seats: Passengers can only ride on the back of motorcycles with specially designed passenger seats and footrests.
- Headlights: While riding, motorcyclists must always keep their headlights on, including during the daytime.
- Rear Reflector: All motorcycles are required to be equipped with red rear reflectors.
Motorcycle Insurance
Motorcyclists must show proof of insurance to register their bikes and maintain minimum liability insurance coverage of $25,000/$50,000 for injury, $50,000/$100,000 for death, and $10,000 for property damage. However, since motorcycles are considered “inherently dangerous,” bikers and their passengers are excluded from traditional no-fault insurance policies. Given that even in relatively minor collisions, motorcyclists risk suffering brutal injuries, bikers are exempt from the threshold for serious injuries.
