In March of 2020, the FDA released the results of their year-long talcum powder investigations. The FDA analyzed 52 talcum powder products for asbestos and found that 9 out of the 52 products tested positive. All other ingredients do not need to be FDA approved. However, they are FDA regulated. The two laws pertaining to cosmetic regulation in the United States are as follows:

1. Federal Food, Drug and Cosmetic Act (FD&C Act): This act prohibits the marketing of adulterated (poisonous or damaging ingredients) or misbranded cosmetics.
2. Fair Packaging and Labeling Act (FPLA): This act requires companies to put labels on their products; listing the ingredients to keep the consumers informed.

Furthermore, it is important to note that the FD&C Act does not require products to be pre-approved by the FDA before being released on the market. This means that products containing asbestos-contaminated talc powder could be on the market for a while before they are tested by the FDA. To ensure compliance with the law, the FDA does conduct inspections to examine facilities and take samples from products to be tested for violations.
