Emergency Vehicle Right-Of-Way Laws in New York

New York law requires that motorists yield the right-of-way to any emergency vehicle which is equipped with and using a lighted red lamp; a series of flashing lights; or an audible signal, such as a siren, exhaust whistle, or air horn. In the Empire State, an emergency vehicle could be a police department vehicle, a fire department vehicle, a volunteer firefighting service vehicle, an ambulance service vehicle, a volunteer ambulance service vehicle, an environmental response vehicle, an ordinance disposal vehicle, or a blood delivery vehicle.

Under Section 1144 of New York’s Vehicle and Traffic Law, drivers must not only yield the right-of-way to an approaching emergency vehicle but:

1. Navigate their vehicle to a position parallel to and as close as possible to the right-hand edge of the roadway;
2. Stop and remain stationary until the emergency vehicle has passed unless otherwise indicated by a police officer; and
