Fortunately, New York State has several labor laws in place to help protect construction workers who are injured on the job. The following are the portions of the New York State Labor Law that are applicable to construction accident cases:

  1. Section 240. Scaffolding and Other Devices for the Use of Employees.

    Section 240 requires all owners, contractors and their agents to construct and maintain any equipment that allows workers to reach elevated heights in a manner which provides proper protection to those who use them.

    Such equipment includes, but is not limited to:

    1. Scaffolding;
    2. Hoists;
    3. Stays;
    4. Ladders;
    5. Slings;
    6. Hangers;
    7. Blocks;
    8. Pulleys;
    9. Braces;
    10. Irons;
    11. Ropes;
    12. Picks; and
    13. Other devices.

    This section also requires that there be a suitable safety rail attached to scaffolding or staging that is more than twenty feet high. Furthermore, scaffolding must be constructed so that it is able to carry four times the maximum weight that it will actually bear.

    Section 240(1) imposes strict liability on employers for injuries resulting from elevation-related accidents. Strict liability means that if you are injured after a fall from scaffolding, ladders or other similar equipment, and your employer failed to provide you with proper safety equipment, then they can be held legally liable for your injuries.

    Faulty ladders may be evidenced by:

    1. Worn or torn rubber footing;

  2. Section 241(6). Construction, Excavation and Demolition Work.

    Section 241(6) requires that construction areas be constructed and operated so as to provide reasonable and adequate protection to construction workers.
